346-05. AN ORDINANCE:
Be it ordained by the City Council of the City of Fitchburg, as follows:
Amending Chapter 169-35 as follows:
169-35. Parking in Snow Emergencies:
(Preamble: This Ordinance shall be effective immediately upon passage by the City Council and remain in effect until April 15, 2008, at that time this Ordinance will revert back to its previous form.)
a) Whenever the Mayor, or his designee declares a snow emergency exits in the city in regard to snow plowing or snow removal by giving at least six (6) hours notice, it shall be unlawful for the owner, operator or person in charge of any vehicle, (other than one acting in an emergency) to park such vehicle or permit or suffer the same to be parked on any public street in this city for the duration of the emergency. The snow emergency will last for a Forty Eight (48) hour period. During this snow emergency the Commissioner of Public Works shall conduct snow plowing, removal, and sand and salt operation.
b) The Commissioner of Public Works shall notify the Fitchburg Police station of such order, along with local TV and radio stations.
c) Any violations of this section will result in a $25 fine and upon the authority of a police officer, the Commissioner of Public Works or the Superintendent of Streets, the vehicle, may be subject to being towed and the owner of such vehicle shall be liable for such charges incurred for the removal and storage of the vehicle.
d) The provision of this section shall not apply to handicapped parking areas located in residential zones. (Added 1-18-1983 by Ord. No. 11-83: amended 12-16-97 by Ord. 511-97: 4-7-1998 by Ord. No. 114-98)
